DUGGIRALA SUBASH Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the fo[[owing: ORDER: This Criminal Petition, under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the peti`tioner/A7 seeking bail in Crime No.02/2025 of Moothugudem Police Station, ASR District. 2. A case has been registered against the petitioner and others for the offence' under Sections 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act. •| 2 3. case of the prosecution, in brI'ef, I-S that on 26.01.2025, on credible I-nformation regardl'ng I'Ilegal possessI-On and transportation of ganJ-a, the S.I of police, along with staff and mediators, started conductI-ng vehicle checking opposite to Moothugudem police statI'On and they found one Maruthi Ertl'ga car comI'ng towards them. on seeing police, the drl'ver of the saI'd VehI-CIe stopped the car and the inmates in the car trI-ed to escape. Then police apprehended some of the persons while the others ran away. on enquiry, the said persons disclosed theI-r I'dentI'ty Particulars, and poll'ce found 126 kgs of ganja in tlleI'r possession. The contraband, along with other material, was seized under the cover of medI-atOrS report, and the accused were arrested and remanded to judicial custody on 26.01.2025 and sl'nce then the petitI'Oner is in judicial Custody. 4. Heardbothsl-des. perusedthe record. 5. Learned Assistant public prosecutor submj{s that majorpari of{he jnves{jgation ['s completed except filing of charge sheet. He further submitted that there are no antecedents reported agajns{ the petitioner. 6. It I'S Subml-{ted that the petI-tI-Oner was piloting the other vehicle wherein 126 kgs of ganja has been seized from the possession of other accused. The petitioner has been jn judicjal`remand sI-nCe 26.01.2025 i.e. for more than 145 days, and major portion of jnvestigatjon has been completed and only formal charge sheet has {o be fI-led. ln view of the `\-,, -.,. J 3 aforesaid facts and ci-rcumstances of the case, this court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner/A7 herein shall be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with . two sureties for the like sum each to the satisfaction of the learned Judicial First class Magistrate, Rampa Chodavaram; (ii) On release, the petitioner shall appear before the station House Officer concerned once I'n a Week i.e. on every Sunday between 10.00 a.m. and o5.00 p.m., till fI'lI'ng Of Charge Sheet.
