1. Applicant has filed this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 70/2016 registered at ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2025.09.22 17:02:58 +0530
2 Police Station – Chirmiri, District - Manendragarh, Chirmiri-Bharatpur (C.G.) for offence punishable under Section 420 read with Section 34 of IPC and Section 4 and 5 of Prize, Chits & Money Circulation Scheme (Banning) Act and Section 10 of Prohibition of Depositors and Investors Act.

Case of prosecution in brief is that report was lodged by one Dharmendra on 28.02.2016 stating that Samruddha Jeevan Multi Estate, Multipurpose Cooperative Society Limited has opened the branch in which he has deposited some money, however, after getting the maturity of the said amount, money was not returned as the cooperative society limited has closed his office and all responsible persons have left the place. Based on the report crime was registered in the month of February, 2016. During investigation applicant was arrested on 04.02.2025.

Learned counsel for applicant submits that applicant has been falsely implicated in the crime, he has not committed offence as alleged. He further submits that though applicant is director of Samruddha Jeevan Multi Estate, Multipurpose Cooperative Society Limited, however, he is not actively involved in functioning of the said society. He is incarcerated in jail since 04.02.2025 and in identical nature of allegation in Maharashtra applicant has been enlarged on bail by High Court of Bombay, hence, he may be enlarged on bail in this case also.
4. On the other hand, learned State counsel opposes the submission made by learned counsel for the applicant and would submit that according to document available in case diary after lodging of the FIR when investigation started investigating agency found that all the
3 persons have left the place and went without even informing to anyone. According to material collected applicant is one of the director of said company and the company is not having license to do business of banking. However, as per allegation, Samruddha Jeevan Multi Estate was actively involved in banking transaction and collected huge amount from innocent persons.
5. I have heard learned counsel for the parties and perused the documents enclosed along with the bail application.

Taking into consideration facts and circumstances of the case, nature of allegation and submission made by learned counsel for the respective parties, I do not find present to be a fit case to allow the application, accordingly, the application is dismissed.
