The instant application has been filed for release of amount of compensation.
This Court has decided the aforesaid appeal on 25.05.2026.
It is contended in the application that since the appeal stands decided, therefore, the entire amount of compensation lying deposited in the Registry of this Court along with upto date interest be released in favour of the applicant by remitting the same in the saving bank account of the applicant.
It is contended by the learned counsel for the non-applicant that the applicant be put to certain terms so that the right of the non-applicant is protected.
In view of the averments made in the application and in view of the submission made by the learned counsel for the applicant, which are supported by an affidavit, the application is allowed and the entire amount of compensation falling to the share of applicant along with upto date interest is ordered to be released in
favour of the applicant by remitting the same in the saving bank account of the applicant, details of which, have been provided in Annexure A-1.
Needless to say that the release of amount shall be subject to undertaking which shall be furnished by the applicant before the Registrar (Judicial) that in case the non-applicant prefers an appeal before the Hon’ble in Supreme Court and in case the said appeal is decided in favour of the non-applicant, the applicant shall refund the entire amount of compensation along with upto date interest to the non-applicant.
Since the appeal as filed by the non-applicant has been partly accepted by this Court, therefore, after making the necessary calculation, the Registry is directed to release the amount of compensation to the applicant after adjusting the amount which is due and admissible to the non-applicant. The application stands disposed of.
