AND Respondent/Complainant Petition under Section 482 of BNSS is filed praying that in the circumstances stated in the affidavit filed in support of the criminal petition, the High Court may be pleased to grant anticipatory bail in Crime No. 1 of 2024 on the file of Kadiri Urban Town Police Station, Sri Satya Sai District and to release the Petitioner/Accused No.4 herein in the event of his arrest in the interest of justice. Ji=f-I- THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY gB_IMINAL PETITION NO: 630 of 202_5_ ORDER: The Criminal Petition, u/See.482 of the B.N.S.S 2023, is filed On behalf of the petitioner/A4 to grant anticipatory bail in connection With cr.No.1/2024 of Kadiri Urban Police Station, Sri Satya Sai District. 2) A case has been registered against the petitioner/A4 and others for the offences punishable under sections 324, 323 rtw 34 I.P.C. 3) Case of the prosecution -In brief iS that On 01.01,2024 at about o5.00 p.m., the informant lodged a report Stating that On 31.12.2023 at 9.00 p.m., while one Bukke Pradeep Kumar and his friend Utti Kumar, were proceeding on their motor cycle near Market, they accidentally dashed the motor cycle of the informant's friend, causing it to fall. The said incident led to a quarrel between them. Later, on the same day at about ll.30 p.m., the Bukke Pradeep Kumar and his friend Utti Kumar along with one Alla Bakash came near Madeena Tea Stall and stabbed the informant and his friends with a scissor, causing bleeding injuries on chest, r'Ight and left hand Shoulders. Immediately, the injured Were Shifted to hospital for treatment. 4) Heard. Perusedtherecord. + fi= .3, , ,:/' I- 2 1 5) On perusal of the material available on record, itgoes to showthat there were disputes between the accused and the de facfo complaI'nant. lnitl'ally, the de facfo complainant lodged a report as against the Al to A3 only. Name of the petitl'oner has not been figured in the report given by the de facfo complainant but later during the course of l'nvestigation, police recorded 161 Cr.P.C., statements, pursuant to which, name of the PetitI'Oner Was Shown aS A4. It appears that there is I'mPrOVement made in the statement of de facfo complaI'nant I-n Sec.161 Cr.P.C statement from the report lodged by him. ln view of the said facts and circumstances, this Court is inclined to grant antl-cipatory bail to the petitioner/A5. 6) Accordingly, in the event of his arrest, petitioner/A5 shall be released on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties for the like sum to the satisfaction of the arresting police officials and also on condition that the Petitioner Shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses.
