Respondents For Petitioner : Mr. A.N. Pandey, Advocate For State : Ms. Akanksha Verma Dabhadker, PL (Hon’ble Shri Justice Arvind Kumar Verma) Order on Board 16/09/2025 ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.18 14:06:14 +0530 2 / 3 1. The instant petition has been filed for seeking a direction for the respondent authorities to consider and decide the claim of the petitioner for grant of patta of the land bearing Compartment No.P- 185, Area 0.40 Hectare, situated at village Kapildevpur, Tahsil- Balrampur, C.G. as the petitioner is in possession of the said land since long period and cultivating the said land. 2. The grievance of the petitioner is that the petitioner has filed the application for grant of patta for the subject land in which proceeding has been drawn and after enquiry it is found by the Panchayat Level Committee that the petitioner is eligible for grant of patta and the matter is pending before the Divisional Level Committee-Balrampur, however, till date the application of the petitioner has not been decided and the same is pending. 3. Learned counsel for the petitioner would contend that the respondent authorities have already granted patta to the similar situated persons in the same part of land & compartment in the same village which would be evident from the order dated 06/04/2022. He would next contend that this Court has also considered the similar matter in WPC No.3916 of 2025 which has been decided on 28/07/2025, therefore, the similar relief may also be granted to the petitioner. 4. Learned State counsel submits that she has no objection in deciding the claim of Van Adhikar Patta of the petitioner. 5. Considering the submission made by learned counsel for the respective parties, the ends of justice would be served if the present 3 / 3 petition is disposed of directing the Respondent Authorities i.e. Respondents No.3 & 4 to consider the application/claim of the petitioner for grant of Van Adhikar Patta, if any pending, and to take any early decision on the said application, subject to meeting all other requisite eligibility criteria and to proceed further within a period of 90 days from the date of receipt of copy of this order. Till the application/claim of the petitioner is decided, the parties are directed to maintain the status -quo, as it exists today. 6. It is made clear that this Court has not expressed any opinion on the merits of this case. 7. With the aforesaid observations, the present writ petition stands disposed of.
