PUBLIC PROSECUTOR The Court made the following: Petitioner, who is accused in Cr.No.46 of 2022 on the file of Pedanandipadu Police Station, Bapatia District (erstwhile Guntur District), filed the present petition under Section 438 Cr.P.C. seeking anticipatory bail. The said crime was registered for the offences punishable under Sections 420, 465, 468 and 471 IPC. ...RESPONDENT/COMPLAINANT 2. Case of the prosecution is that the de facto complainant is working as Chairperson of the Primary Agriculture Co-operative Society (for short, ‘the PACS’) since July 2021. About 12 villages were there in the jurisdiction of the said Society. Whenever the ryots approach the Society for loans, the C.E.O. of the Society by name Kondepati Bhaskara Rao used to verify residential documents, Pattadar Passbooks, ownership of the lands, 1-B Adangals, E.C. and other mortgaged documents and after satisfying himself that they are in proper line, he used to recommendthe same to the de facto complainant for granting loans. After confirming the same, the Chair person / de facto complainant send papers to the Bank for granting loans to the concerned ryots. It is alleged that subsequently some of the accused / ryots obtained loans by producing fake documents and caused loss to the extent of Rs.24.00 lakhs to the Society. On the basis of the said allegation, the present crime has been registered against the petitioner and others. 3. Learned courfeel for the petitioner contends that no role has been attributed to the Branch Manager. All the verification of documents is the duty of the C.E.O. and Chairman of the Society. He further contends that the petitioner worked as Branch Manager in Prathipadu, Guntur at the relevant point of time. He further contends that he never worked as a Branch Manager in Kakumanu Branch. 4. Be that as it may, as it is the duty of the Chairman and C.E.O. of the Primary Agriculture Co-operative Society to verify all the documents and recommend to the Bank for granting loans, prima facie the petitioner is no way 'r responsible for the same. As such, this Court is inclined to grant anticipatory bail to the petitioner on the following conditions: i) Petitioner / Accused is directed to surrender before the Station House Officer, Pedanandipadu Police Station, Bapatia District (erstwhile Guntur District), on or before 25.04.2025. On such surrender, the Station House Officer, Pedanandipadu Police Station, Bapatia District, is directed to release the petitioner / Accused on bail on his executing a personal bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the Station House Officer, Pedanandipadu Police Station, Bapatia District, release, the petitioner / Accused is directed to cooperate with investigation After his ii) Petitioner / Accused shall make himself available for interrogation as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
