1. Instructions preferred on behalf of learned AGA is taken on record.
2. Present application has been preferred with the prayer to quash the entire proceeding of charge sheet dated 29.01.2025 in G.T. no. 286/2025, pending before Gangster Court, F.T.C.II, District Mau in between State vs. Amzad and others arising out of Case Crime no. 0258/2024 u/s 3(1) of U.P.Gangster and Anti-Social Activities (Prevention) Act, 1986, PS- Kotwali Mau, District Mau and cognizance cum summoning order dated 18.03.2025 in G.T. no. 286/2025.
3. On previous occasion, argument was raised by learned counsel for applicant that entire proceeding is liable to be quashed in pursuance to Gangster Act since while preparing the gang-chart, no joint-meeting has been held by the authorities concerned. Over the said arguments, instructions have been called vide order dated 30.04.2025 from learned AGA specifically over the issue that whether any minutes of the meeting, if held jointly between Superintendent of Police and District Magistrate of District Mau for preparation of gang-chart, is available?
4. Today, learned AGA came up with the specific instructions through which the minutes of the meeting held on dated 06.08.2024 has been placed and the same is also apparent from the gang-chart itself.
5. In view of aforesaid discussion, the ground taken up for seeking quashing of entire proceeding is not sustainable since the preparation of the gang-chart is altogether in consonance with the provisions available under the Gangster Rules,
2021.
6. The instant application stands dismissed accordingly. Order Date :- 15.5.2025 Shaswat Digitally signed by :- SHASWAT SINGH High Court of Judicature at Allahabad
