The petitioner has filed the petition seeking following reliefs:- “(i)That, this Hon'ble Court may kindly be pleased to call for the entire records in respect of the petitioners before this Hon'ble Court for its kind perusal. (ii) That, this Hon'ble High Court may kindly be pleased to direct the Respondent No. 1 Secretary Department of Home/Police to decide the pending representation on Petitioner No. 2 (Annexure P/6) for grant of compassionate appointment to Petitioner No. 2 Pankaj Sinha on the post of ASI (A/M) according to circular dated 13.11.2020 and also on the ground of parity with other persons. (iii) That this Hon'ble Court may further be pleased to grant any other relief, which is deemed to be fit by this Hon'ble Court.” 2. Learned counsel for the petitioner submits that the petitioner No.1 is the widow of Late Shri Murlidhar Sinha who died in a naxalite operation and is declared Martyr by the State Government and accordingly the petitioner No.2, who was minor at that time, was 3 given compassionate appointment on the post of Bal Arakshak vide order dated 02.04.2013. Subsequently, upon his attaining majority, the petitioner No.2 was directed to appear before the proceedings in order to appoint him on the post of Constable GD. He submits that the petitioner has filed this petition stating that according to circular of the State Government dated 13.11.2020 passed by the DGP in the case of compassionate appointment to the legal heirs of Martyr, the person concerned can be given appointment on the post of ASI (A/M) as per his qualification and eligibility. It is further submitted that the petitioner is eligible for the post of ASI (A/M) as such, the respondents may be directed to consider and decided the case of the petitioner in light of the circular dated 13.11.2020 issued by the Director General Of Police (DGP), State of Chhattisgarh. 3. Learned counsel for the respondents does not have any objection to the submission made by learned counsel for the petitioner and submits that if the petitioner files appropriate application along with the relevant documents before the respondents No.1 & 2, then the same would be considered in accordance with law. 4. Considering the facts and circumstances of the case, submissions advanced by learned counsel for the parties, particularly taking note of the fact that the father of the petitioner No.2 was died in a Naxalite operation and he was declared Martyr, it is directed that the petitioner shall file an appropriate application along with all the necessary documents before the respondents No.1 & 2 within a 4 period of three weeks from the date of copy of this order and the respondents No.1 & 2, in turn, shall consider and decide the same within a period of four weeks from the date of receipt of such application of the petitioner, strictly in accordance with law, while considering circular dated 13.11.2020 issued by the DGP, State of Chhattisgarh. 5.
