1. Heard Anchal Kumar Matre, learned counsel for the petitioner. Also heard Shri Sangharsh Pandey, Govt. Advocate. for the respondents/ State. 2. The petitioner has filed this petition praying for following relief:-
“10.1 A writ and/or an order or a direction for respondents to produce the wife of the petitioner before this Hon'ble High Court. 10.2 A writ and/or an order or a direction for respondents to release the wife from illegal custody and allow her to make a free and independent choice regarding her residence and safety as well as
3 safety of the child in womb of the wife of petitioner. 10.3 A writ and/or an order or a direction not to harass the petitioner and his family and not to disturb the matrimonial life of the petitioner. 10.4 Any other reliefs, which Hon'ble Court may deem fit in the facts and circumstances of the case. 10.5 Cost of the petition may also be awarded.”
3. At the very outset, learned State counsel has pointed out that no details of the corpus have been mentioned either in the prayer nor she has been impleaded as one of the party respondent in the present petition. 4.
At this Juncture, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for, subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court and producing the receipt of the same at the time of filing of the fresh petition, if any. The said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri,
