PUBLIC PROSECUTOR The Court made the following Order: ...RESPONDENT/COMPLAINANT This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A4, seeking regular bail, in Crime No.232 of 2024 of Government Railway Police Station, registered for the offences punishable under Sections 20(b)(ii)(B), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution is that, on 22.07.2024, the RPF/SI along with his staff while conducting checking at platforms of Visakhapatnam Railway Police Station, found A1 and A2 in possession of 10Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the record. 2 Learned counsel for the petitioner submits that basing on the confessional statement of A1 and A2, the petitioner herein/A4 is arrayed as accused in the present crime. Except the confessional 4. statement, no other incriminating material is collected showing the Moreover, the complicity of the petitioner in the present crime, contraband involved in the present crime is only 10Kgs of Ganja, which is not a commercial quantity and the petitioner herein was arrested on 02.03.2025 and since then he has been in judicial custody. Learned Assistant Public Prosecutor opposed to grant bail on the ground that investigation in the present is not completed. It is submitted by the learned counsel for the petitioner that the petitioner has permanent abode and there is no possibility of his fleeing away from the Jurisdiction of the Court. In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused basing on the confessional statement of A1 and A2 and the contraband involved in the present is not a commercial quantity, this Court is inclined to grant bail to the petitioner herein/A4, on the following conditions, i. The petitioner herein/A4 shall be released on executing a personal bond for Rs. 10,000/- (Rupees ten thousand only) with one surety for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam. 5. 3 ii. On release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months, iii. The petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. Accordingly, the Criminal Petition is allowed. 6.
