2 16/09/2025 The present writ petition has been filed by the petitioner seeking a direction commanding the respondents to pass the final order on his application for consolidation of Khasra Numbers and for issuance of a new Khasra Number along with updated land records. 2. Contention of the counsel for the petitioner is that the petitioner is the lawful owner fo the subject property comprising of Khasra No. 3493/Ka admeasruing 0.0400 hectares and Khasra No. 637/5/Kha admeasuring 0.1570 hectares situated at village Korba, Tehsil and District Korba. An application for consolidation was filed by the petitioner on 5th December 2024. Pursuant thereto, an inquiry was conducted by the Patwari who after due publication and in absence of any objection, submitted a positive recommendation dated 2nd June 2025 to the competent authority. Despite the said recommendation and even after the petitioner’s representation dated 21st August 2025, the matter has been kept pending without justification and the final order has not been passed by the respondents. The inaction on the part of the respondents is wholly unsustainable and amounts to abdication of their statutory duties. 3. Taking into consideration the facts of the case, this Court is of the considered view that the right to property being recognized as a valuable constitutional and human right, cannot be allowed to be defeated by sheer inaction or indifference on the part of the authorities. Once the due process has been undertaken and no legal impediment
3 exists, the authorities are duty bound to conclude the proceedings expeditious. 4.
In the circumstances and without commenting on the merits of the case, this petition deserves to be disposed of with a direction to the respondent No.4 Tahsildar, Korba to pass final order on the application of the petitioner for consolidation of Khasra Numbers and issuance of a new Khasra Number along with updated land records, expeditiously, strictly in accordance with law preferably within a period of 60 days from the date of receipt of certified copy of this order. It is made clear that this Court has not expressed any opinion on merits of the case and the Tahsildar shall pass the order strictly in accordance with law. No order as to costs.
