For Petitioner(s) : Mr.Ganesh K For Respondent(s) : For Intervenor : Mr.P.Dhileepan, Government Advocate (Crl.Side) Mr.Jerry V.V.Sundar ORDER The petitioners apprehend arrest for the alleged offence under Sections 408, 477A, 420, 34 of IPC, 1860 in Crime No.6 of 2024, seek anticipatory bail. 2. The case of the prosecution is that the petitioner while working as a Managing Director of the de facto complainant’s company involved in https://www.mhc.tn.gov.in/judis CRL OP No. 266 of 2025 __________ Page2 of 4 misappropriation of Rs.4.5 crores. Hence, the complaint. 3. The learned counsel for the petitioner submits that the occurrence took place on 11.04.2024 and the First Information Report has been registered during the year 07.08.2024. He further submits that the entire complaint has been filed on the basis of mere surmises and conjectures, without any substantive material. He further submits that the de facto complainant is not in a position to demonstrate the allegations against the petitioner. Further, this Court has already directed the parties to go for a mediation which did not give any fruitful result. Hence, he prays to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the investigation is still going on and the petitioner is not co-operating. 5. I have given my anxious consideration to the submissions made by the learned counsel on either side and also perused the records available. 6. Though the learned counsel for the intervenor would object the contentions made by the learned counsel for the petitioner, this Court is of the view that at this length of time, the custodial interrogation of the petitioner is not required. Hence, the interim order granted by this Court on 17.12.2025 is made absolute and all other conditions imposed in the above order remains intact. 6.
