2025
1. This is an ofÏce reference.
2. This Court, vide order dated 19.07.2024, passed in MCRC No. 3405 of 2024, while allowing the bail to the applicant, namely, Naresh Vaishnav, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal impediment.
3. The learned Additional Sessions Judge (FTC) Raipur District-Raipur KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 (C.G.) vide his request letter dated 09.01.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD, that in this case currently 04 prosecution witnesses have been examined out of 14 prosecution witnesses and 10 prosecution witnesses have left to be examined, despite repeated efforts and issuance of summons/warrants on multiple dates (14/08/2024, 06/09/2024, 20/09/2024, 05/10/2024, 26/10/2024, 20/11/2024, 03/12/2024, 16/12/2024, 08/01/2025), the remaining witnesses have not been presented due to non-compliance by the concerned police station in-charge. As a result, it seems unlikely that the case can be concluded within the stipulated timeframe. Hence, she prays for grant of further more time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of five months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
