This application under Section 528 Bharatiya Nagarik Suraksha Sanhita (hereinafter referred to as BNSS) has been preferred against order dated 06.03.2025, passed by Additional Sessions Judge, Court No.13, Agra in Complaint Case No.105 of 2021 / Session Case No.615 of 2022 (Jaipal Singh Vs. Jitendra Pal Singh and others), under Sections 323, 504, 506, 392, 364 IPC, Police Station- New Agra, District- Agra, pending before the Court of Additional Sessions Judge, Court No.13, Agra. 3. It is submitted by learned counsel for the applicant that in the above referred case applicant was granted anticipatory bail and thereafter he was regularly appearing before the trial Court. On 06.03.2025 a demise has taken place in family of applicant, due to which he could not appear before the trial Court and non-bailable warrants have been issued against him. Referring to facts of the matter, it was submitted that impugned order is against facts and law and thus liable to be set aside. 4. Learned AGA has opposed the application and submitted that there is no illegality or perversity in the impugned order. 5. Considering facts of the matter, it is directed that in case applicant appears / surrenders before the trial Court concerned within a period of three weeks from today and applies for cancellation of warrants / for bail, the same shall be considered and decided expeditiously in accordance with settled law. For a period of three weeks from today or till the applicant surrenders before the trial Court concerned, whichever is earlier, no coercive action shall be taken against the applicant in the aforesaid case. 6. With the aforesaid observations, the application under Section BNSS is disposed of.
