Neutral Citation No. - 2025:AHC:88191 Court No. - 38 Case :- WRIT - A No. - 17670 of 2014 Petitioner :- Jogendra Singh Chauhan Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Gaurav Singh,Rajneesh Tripathi,V.K. Singh Counsel for Respondent :- Nitinjay Pandey,Prabhakar Awasthi Hon'ble Donadi Ramesh,J.
1. Heard Mr. Kripa Shankar Singh, learned Senior Counsel assisted by Mr. Gaurav Singh, learned counsel for the petitioner and Mr. Prabhakar Awasthi, learned counsel for respondent no. 5. 2. The instant writ petition is filed by the Principal, National Inter College, Bhogaon, Mainpuri questioning the order dated 30.01.2014 passed by the Joint Director of Education, Agra region, Agra. 3. By virtue of the said order the second respondent has granted relief to the fifth respondent by granting salaries to him. As he is not entitled for such benefit because he lost his litigation up to the Apex Court hence he is not entitled for the said relief. 4. In the instant writ petition, taking the facts into consideration, this Court has passed an order dated 16.08.2012 directing the fifth respondent to allowed him to work as lecturer in the institution and the management and principal shall not cause any interference in the same and payment of salaries would be considered after exchange of affidavits. 5. By virtue of the said order, learned counsel appearing on behalf of the fifth respondent has submitted that he has continued and is working since then but despite the same the said respondents have not released the salaries in view of the pendency of the present writ petition. 6. Considering the submissions of both the counsels and also on the perusal of the record it shows that as the writ petition is filed by the principal and not by the institution and the fact remains that the petitioner has already retired way back. In view of the said circumstances, nothing survives in the writ petition. Accordingly,
same is dismissed. It is needless to say that in view of the orders passed by this Court, dated 16.08.2012, the fifth respondent was allowed work on the said post, hence, he is entitled for the release of all the salaries. It is needless to say that the impugned order, dated 30.01.2014 passed by the Joint Director of Education may implement in true spirit.
