Applicant has filed this application under Section 447 B.N.S.S. seeking transfer of CAse No. 376 of 2025, titled State Vs. Devendra and others, arising out of Case Crime No. 47 of 2024, under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Mahila Thana, District Ghaziabad, pending before the Civil Judge (J.D.), Ghaziabad to the court of competent jurisdiction at Bulandshahar. Concededly, the applicant-wife had initially lodged the F.I.R. at Ghaziabad against her husband and others under Section 498-A I.P.C. etc. and later, she instituted a case under Section 125 Cr.P.C. at Bulandshahar. Learned counsel for applicant prays for transfer of the criminal trial on the ground that it is difficult for the wife-applicant to pursue the criminal case, who is presently residing at Bulandshahar with the parents. Heard. Convenience of one of the parties cannot be construed as a valid ground for transfer of the case, particularly keeping when the distance between Ghaziabad and Bulandshahr is only 60 kilometers.
