Case(C) NO. 667 OF 2025 3 2025:KER:28243 D. K. SINGH, J. -------------------------- Con. Case(C) No. 667 of 2025 ------------------------- Dated this the 1st day of April, 2025 JUDGMENT 1. The present contempt petition has been filed alleging willful non-compliance and disobedience of the Judgment dated 05.08.2022 in W.P.(C) No. 24079 of 2021. 2. This Court, while disposing of the writ petition issued the following directions; “9. As far as the revision of pension is concerned, certainly, I find favour with the submissions of the learned Special Government Pleader – Sri.Santhosh Kumar, that the Government must take a decision on this, before the petitioners can claim it, particularly when the financial outlay for the same will have to be carefully worked out and provided for. In the afore circumstances, these Writ Petitions are ordered with the following directions: a) The pension due to the petitioners and other retired eligible employees of the KSRTC for the months of July and August 2022 will be ensured to be paid by the competent Authority of the Government, not later than 25.08.2022. b) As far as pension for September 2022 and the succeeding months are concerned, it shall be disbursed by the competent Authority of the Government within the first week of such months, and if possible, within the first five days thereof. c) The Government will consider the recommendations of the KSRTC relating to revision of pay and pension to their employees and retired employees respectively, after necessary deliberations with all stakeholders, including the Unions, petitioners herein and Con. Case(C) NO. 667 OF 2025 4 2025:KER:28243 any other person who may be interested; and will take a final decision thereon, as expeditiously as is possible. I make it clear that am not fixing a time frame for this exercise solely adverting to the request of the learned Special Government Pleader; but record that it is the hortative hope of this Court that the Government will act expeditiously and without delay.” 3. In pursuance to the notice issued to the respondent, the affidavit of the Chief Secretary has been placed on record. As per the said affidavit of compliance, the pension of all employees retired from KSRTC has been paid in respect of the 13 districts and in respect of one district i.e., Alappuzha district, the pension shall be disbursed within a week. 4. Considering the aforesaid facts, the present contempt petition is hereby closed with a direction to the respondent to pay the pension of the retired employees of KSRTC of Alappuzha district within a period of one week.
