Judgment 28/11/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 190/2025 registered at Police Station Transport Nagar (Jaipur City East) District Jaipur City East for the offence(s) under Sections 65(1), 351(3) BNS and Section 3, 4, 11/12 of POCSO Act.
2.
Learned counsel for the accused-applicant submits that the applicant is sole bread earner of the family aged 25 years. It is submitted that there is no criminal antecedents registered against the applicant and charge-sheet has been filed. It is further submitted that FIR was lodged with an inordinate delay from the date of first incidence. It is also submitted that even in the FIR it is admitted that victim and applicant are in close acquaintance.
Learned counsel has submitted that victim in question is touching the age of majority. Learned counsel further submits that the
[2025:RJ-JP:48454] (2 of 2) [CRLMB-14515/2025] conclusion of trial is likely to take a long time and no useful purpose would be served by keeping the applicant behind bars till disposal of the case.
3. Per contra, learned Public Prosecutor along with counsel for the complainant have vehemently opposed the bail application. It is submitted that at the time of first incidence, victim is a minor girl aged 15 years and provisions of POCSO Act are applicable.
4. Having heard the arguments advanced by the learned counsel for the parties and considering the fact that accused- applicant is sole bread earner of the family aged 24 years; that there is no criminal antecedent registered against the accused- applicant; that FIR itself reveals that accused-applicant and victim are in close relationship; that charge-sheet has already been filed; that victim in question is touching the age of majority and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused- applicant and enlarge him on bail.
5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Shokeen Qureshi Son of Shri Mukeem Khan shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
