Puram Bela, PNT Road, P.S.- Mithanpura, District - Muzaffarpur ... ... Petitioner/s Versus 1. The State of Bihar through the Superintendent of Police, Muzaffarpur Bihar 2. The Deputy Superintendent of Police, Muzaffarpur Bihar 3. The Staton House Officer, Mithanpura, P.S.- Mithanpura, District - Muzaffarpur Bihar ... ... Respondent/s ====================================================== Appearance : For the Petitioner/s : Mr.Saket Tiwary For the Respondent/s : Mr.A.A.G.12 ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 2 06-05-2025 Heard the parties. 2. This application has been filed on behalf of the petitioner for quashing the Mithanpura P.S. Sanha No. 0877 and 0904. 3. It has been submitted on behalf of the petitioner that the petitioner is a business man dealing in land and because of business rivalry he has been implicated in three cases but no case is pending for investigation at present. He further submits that respondent no. 3 instituted two sanha in which it has falsely been mentioned that the petitioner has amassed huge wealth which has been earned by proceeds of crime and based on the sanha the Superintendent of Police had filed an application before the CJM, Muzaffarpur under Section 107 of the BNSS Patna High Court CR. WJC No.930 of 2025(2) dt.06-05-2025 2/4 and made a request for forfeiture of the properties of the petitioner and based on the said application notice has also been issued to the petitioner. 4. Learned counsel for the petitioner further submits that a conjoint reading of Section 107 of the BNSS will show that the investigating officer had the power to file an application before the Court seeking seizure of the property if only, during investigation, he came to conclusion that the properties have been earned by illegal acts. 5. Learned counsel for the petitioner further submits in the present case, the sanha has been instituted in a very casual manner by the respondent no. 3 when no investigation was pending against the petitioner and the respondent no. 3 was not investigating any of the cases lodged against the petitioner. 6. Learned counsel for the petitioner next submits that the sanha has been instituted against the petitioner with a mala fide intention without any proof that the property has been amassed by the petitioner through the proceeds of crime and therefore both the sanhas may be quashed. 7. Learned counsel for the State has submitted that the petitioner is a dreaded criminal and he is also accused in Patna High Court CR. WJC No.930 of 2025(2) dt.06-05-2025 3/4 three serious cases which includes the case of triple murder wherein the petitioners were alleged to have caused death of the husband of the deceased and his two bodyguards. It is a case wherein the petitioners and other co-accused persons were involved in extortion of money and the husband (deceased) of the informant was a real state businessman who was killed for non-fulfillment of demand of extortion money along with his two bodyguards. 8. Learned counsel for the State further submits that the petitioner is also said to be involved in the murder case of a Mayor. He further submits that the petitioner is a dreaded criminal and he may not be granted any relief from this Court as he is involved in murdering people in Muzaffarpur because of land disputes. 9. I have considered the submissions advanced on behalf of the petitioner and on behalf of the State. 10. From the allegations made in the cases registered against the petitioner, it is clear that multiples criminal cases are pending against him, including murder, land grabbing and extortion. 11. Moreover, the present application is also premature and considering the submissions of the petitioner, no Patna High Court CR. WJC No.930 of 2025(2) dt.06-05-2025 4/4 cogent grounds are made out for warranting interference from this Court at this stage. Accordingly, this application is dismissed. Vikas/- (Sandeep Kumar, J) U
