Heard Mr. Yashraj Verma, learned counsel holding the brief of Mr. Amrito Das, learned counsel for the petitioners as well as Mr. Siddharth Pandey, learned counsel, appearing for respondent. 2. The petitioners have filed this transfer petition under Section 447 of the Bharatiya Nagarik Suraksha Sanhita with the following prayers : “It is therefore, prayed that his Hon’ble Court may kindly be pleased to transfer the Case No.14/2023 pending before the learned Judicial Magistrate First Class, Pakhanjur, Kanker, Chhattisgarh, to the Court having competent jurisdiction at Raipur, in the interest of justice.” 3. Learned counsel for the petitioners submitted that the respondent herself initiated a separate case against the petitioner No.1 before the Family Court, Raipur and is presently residing at Raipur (C.G.). He further submits that the respondent and her family exert influence at Pakhanjur and therefore there is a constant threat to the well begin of the petitioners and their witnesses, if they visit Pakhanjur as they have already been threatened by the respondent and her family in this regard. He also submits that is shall be convenient for the parties and even the witnesses to 3 attend the proceedings at Raipur or any other competent Court. 4. Learned counsel for respondent submits that the respondent has no objection if Case No. 14/2023, which is pending before the JMFC, Pakhanjur, Kanker (C.G.), will transferred to Raipur (C.G.). 5. In view of the submission made by learned counsel for the respondent that the respondent has no objection if Case No. 14/2023, which is pending before the Judicial Magistrate First Class, Pakhanjur, Kanker (C.G.), will transferred to Raipur (C.G.), Judicial Magistrate First Class, Pakhanjur, Kanker (C.G.) is directed to transmit the record of Case No. 14/2023 to Judicial Magistrate First Class, Raipur within a period of two weeks from the date of production of certified copy of this order. 6.
