ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“ tcy-issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus challenging the open action notice vide Rc.No.1034/2013/A1, Dt 04.12.2014 issued by the 2"'^ respondent for allotment of shops on lease in respect of shops located at Tadipatri Road, Old Block, ground floor and first floor, Tadipatri Road, New Block, Seshagiri Satram, Anantapuram city, without reserving for allotment of shops on lease to the members of scheduled tribes under Rule 12 (h) of A.P.Municipalities (Regulations of Receipts and Expenditures) Rules 1968 is illegal and arbitrary and consequently direct the respondents to reserve the shops to ST category people in allotting leasehold rights in the shopping complexes of Anantapuram Municipal Corporation and pass such other orders....”
2. This Court had passed an interim order dated 11.12.2014 permitting the respondents to proceed with auction pursuant to the auction notice dated 04.12.2014, but not finalize the same.
3. Learned counsel for the petitioners would submit that there are no instructions from the petitioners to proceed with the matter.
4. As the lease of shops is for a limited period, the cause in the writ petition may not survive in view of passage of time. The present Writ Petition, is therefore, dismissed for non-prosecution. However, the petitioners are at
liberty to re-agitate the issue as and when cause arises. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
