1. Heard.
2. This Revision is filed against the impugned order dated 23.10.2024 passed in Civil Suit No.59-A/2023 by the Civil Judge, Senior Division, Bagbahara, Mahasamund (CG).
3. At the outset, learned counsel for the applicants would submit that the trial Court has observed that the question of limitation is a mixed question of law and fact, therefore, this Revision may be disposed of with liberty to the applicants to raise all such ground(s) after framing of proper issues and address the same at the appropriate stage.
4. Learned counsel appearing for the respective respondents would not oppose the said prayer .
5. In view of the above, this Revision disposed of with liberty to the applicants to file an appropriate application under Order 14 Rule 5 of the CPC for framing of proper issues, if no such issue(s) has been framed.
6. It is made clear that if any such application is filed by the applicants, the same shall be decided by the concerned Court, on its own merits, strictly in accordance with law. Sd/- (Deepak Kumar Tiwari) Judge
