The petitioners in the instant writ petition are the recorded owner and occupiers being plot no. 681 J. L No. 152 under Mouza Harasankar, Police Station Panskura, District Purba Medinipur total area about 37 decimal in out of 74 decimal of land being Khaitan Nos. 503, 504, 975 and 976. 2. The petitioners have filed an appeal before the Executive Officer, Panskura Block, being the respondent no.9 under Rule 38 Sub Rule (1) of the West Bengal Panchayat (Gram Panchayat Administration ) Rule 2004 with regard to the unauthorized construction over the said plot being made by the private respondents upon obtaining sanction plan which the petitioners allege that has been obtained fraudulently. The same appeal has been filed before the authority concerned on 13th October, 2025. 2 WPA 24181 of 2025 3. Learned advocate for the State respondents submits that the building has been constructed by obtaining sanction plan. 4. After hearing the respective parties and perusing the materials on record, I am of the considered view that since the disputed question is with regard to obtaining the sanction plan for constructing the building in question, let the appeal filed before the respondent no.9 be disposed of upon giving an opportunity of hearing to the interested parties within a period of six weeks from date and the order so passed shall be communicated to the respective parties. 5. There shall be an order of status quo as to the nature and character of the land as of today which shall abide by the result of the appeal. 6. The petitioners are directed to communicate this order to the private respondents. 7. With the above observation and directions the writ petition stands disposed of. 8.
