Present application-Abhinav Raj Singh Sengar is praying for short term bail in relation to FIR dated 09.08.2024 registered as FIR No. 24 of 2024 wherein the present applicant has been implicated for the offences punishable under Sections 318(4), 319(2), 61(2) of BNS read with Section 66D of the Information Technology (Amendment) Act at P.S. Cyber Crime Rudrapur District Udham Singh Nagar. 4. It is contended in the short term bail application that wife of the present applicant is hospitalized in District Hospital Kanpur since last one month and her condition is serious as she has been diagnosed with gastrosepsis with acute kidney injury, chronic cholecystitis with cholelithiasis with right renal cyst with chronic cystitis. It is also submitted that Doctor advised surgery of the wife of the applicant. He submits that there was a love marriage of the present applicant and no other family member of his family is supporting him, however, mother-in-law of the applicant is supporting him who filed an affidavit in support of the instant short term bail application. 5. Mr. Pal, learned A.G.A. submits that the officials have verified this medical report and the disease which has been diagnosed is correct and she has been 2025:UHC:2684 advised to undergo surgery. 6. After hearing the learned counsel for the parties and further taking into consideration that the wife of the application is diagnosed with gaestrosepsis with acute kidney injury, chronic cholecystitis with cholelithiasis with right renal cyst with chronic cystitis and advised for surgery this Court is of the view that the applicant deserves short term bail for a period of three months. 7. Accordingly, short term bail application is allowed. 8. Let the applicant Abhinav Raj Singh Sengar be released on short term bail for a period of three months, to be reckoned from the date of his release, on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 8. Needless to say on completion of period of three months, from the date of release, he shall surrender before the learned trial court. On such an event he will be remanded to the custody.
