IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.15066 of 2025 1.Sanu Suna 2.Subodh Naik 3.Binod Naik …. Petitioners Mr. S.K. Sahu, Advocate -versus- State of Odisha …. Opposite Party Mr. S.K Lenka, ASC CORAM: JUSTICE V. NARASINGH Order No. ORDER 05.01.2026 01. 1. Heard learned counsel for the Petitioners and learned counsel for the State. 2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.370 of 2025 pending in the Court of learned NGN-cum-J.M.F.C, Attabira, arising out of Attabira P.S. Case No.389 of 2025 for commission of offence punishable under Sections 296/115(2)/117(2)/109(1)/3(5) of BNS. 3. It is submitted by the learned counsel that though the Petitioners had earlier approached this Court in ABLAPL No.12910 of 2025, there is no embargo for filing successive bail application. 4. It is further submitted that since the injuries sustained by the injured are simple in nature, the Petitioner may be protected by pre-arrest bail. 5. Learned counsel for the State opposes such prayer, inter alia, on the ground that one of the injuries is on the vital parts. 6. Taking into account the rival submissions, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed subject to verification of criminal antecedent. 7. If it comes to fore that the Petitioners have criminal antecedents of similar nature, this order shall not be given effect to. 8. It is needless to state that the Petitioners shall cooperate with the ongoing investigation. 9. Accordingly, the ABLAPL stands disposed of. (V. NARASINGH) Judge PKS
