The Petition comI'ng On for hearing, upon perusI'ng the Petition and the: memorandum of grounds filed in support thereof and upon hearing the arguments of M/s AISHWARYA NAGULA Advocate for the petitioner, and of PUBLIC PROSECUTOR, for the Respondent, the court made the following THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 629 of 2025 ORDER: The Criminal Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/A47 to grant anticipatory bail in connection with Crime No.199/2022 of Macherla Town Police Station, Palnadu District. 2. A case has been registered aga-lnst the petitioner and others for the offences punishable under Sections 143,147,148, 448, 427, 436, 323 & 149 lPC. 3. Case of the prosecution in brief is that the defacto complajnant is a resident of plot no.303 in Pavani Apartment, Macherla and her husband is a Telugu Desam Party activist. On 16.12.2022, one member of the then opposition party went to attend a programme. ln that programme, there was a clash ensued between the members of TDP party and YSRCP party. ln that incident, the accused and some others formed themselves into unlawful assembly and set ablaze the vehicle of TDP party. Later, they went to society colony and destroyed the TDP party office. Subsequently, all the accused reached the apartment of the defacto complainant armed with sticks and stones and damaged the cars and motorcycles which were parked in the parking area and also -,-,9 tr3zc=zc_.ZFff-I- ``. -_ || rushed to the house of the defacto complainant and damaged the furniture. 4. Heard, Perused the record. 5. A perusal of the materl'al available on record goes to show that name of the petl'tioner had not been referred in the F.I.R. At a belated stage, after lapse of two years, police examined some witnesses and they alleged to have stated name of the petitl-oner herein that he along with others trespassed l'nto the house of the defacto complal-nant and damaged the furniture in his house. As the name of the petitioner was not mentioned in the F.I.R. and after lapse of two years, based on the statement of wl'tnesses, name of petl'tioner was figured in the crime and as the petitioner is apprehending arrest, this court is inclined to grant the prayer of the petitl'oner for grant of anticipatory bail. 6.
