2. On oral motion of the learned counsel for the applicant, permission to amend the application is granted. Amendment be carried out forthwith. 3. Admit. 4. The applicant seeks quashing of the First Information Report bearing Crime No.0157/2024 registered with Police Station, Mangrul Chawhala, District Amravati (Rural) for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code and charge-sheet No.8/2025 filed in Regular Criminal Case No.61/2025 before Judicial Magistrate First Class, Nandgaon Khandeshwar. 5. The First Information Report indicates that the applicant was working as Headmaster in Prashna Chinha Adiwasi Ashram School, Mangrul Chawhala. It is alleged that the applicant promised non-applicant no.2/complainant that he will provide her a job on payment of 7 lakh. Out of the total amount of 7 lakh, ₹ ₹ non-applicant no.2 paid an amount of 2 lakh to the applicant. It ₹ is alleged that the applicant gave her the appointment letter for the post of Swayampaki (Cook) and informed her that the proposal for her appointment has been sent for approval. However,
3 apl529.25.odt no proposal was actually sent. The applicant had issued a cheque towards security but the same could not be honoured as it expired. It is also alleged that the applicant had issued a false and fabricated appointment letter. Therefore, on the complaint of non- applicant no.2, the aforesaid offence came to be registered against the applicant. 6. Non-applicant no.2 is personally present in the Court today, who has been duly identified by her counsel. Learned counsel for non-applicant no.2 has tendered across the bar, the affidavit of non-applicant no.2, which is taken on record and marked as “X” for identification. It is contended in the affidavit that the matter has been amicably settled between the applicant and non-applicant no.2 and only due to misunderstanding and miscommunication, the aforesaid FIR came to be lodged. It is further contended that she has no objection if the FIR against the applicant is quashed. 7. It appears that the dispute is arising out of a financial transaction between the applicant and non-applicant no.2. Thus, the dispute appears to be private in nature. 4 apl529.25.odt

Since, the matter is settled out of the Court and non- applicant no.2 does not want to prosecute the applicant, continuation of prosecution will be nothing but a futile exercise. 9. In view of the above, a case is made out for exercising the inherent powers of this Court to quash the FIR. Hence, the following order is passed: i. The criminal application is allowed. ii. First Information Report bearing Crime No.0157/2024 registered with Police Station, Mangrul Chawhala, District Amravati (Rural) for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code and charge-sheet No.8/2025 filed in Regular Criminal Case No.61/2025 before Judicial Magistrate First Class, Nandgaon Khandeshwar against the applicant are hereby quashed and set aside subject to the applicant depositing costs of ₹2,000/- (Rupees Two Thousand Only) to “Public Welfare Fund” with Union Bank of India, High Court Branch, Nagpur having Account No.129712010001014 and IFSC Code UBIN0812978
