This writ petition has been filed for setting aside the order granting ad-interim injunction to the plaintiff-respondent. In the suit instituted by the plaintiff-respondent, an application for grant of temporary injunction was moved, in which, an ad interim injunction has been granted, against which, the defendants have filed their objections, which are pending consideration. Learned counsel for the petitioner submits that despite penedency of the objections in the application for grant of temporary injunction, the Court below has proceeded to permit the plaintiff to raise constructions over the property in dispute. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to the sole respondent, with a direction upon Civil Judge (Junior Division), Fatehabad, Agra to decide the temporary injunction application filed in Original Suit No.65 of 2025, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order, considering the objections filed by the defendants- petitioners. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
