The above-enumerated C,Cs. are sought to be quashed by the Petitioner/A-7, hence the CrI.Ps. ^ As seen from the proceedings; sheet, Sri K.Siva Rama Krishna, learned counsel appeared before this Court on 21.12.2024 and offered to file vakalat for Respondent No.2. As per the office note, no such vakalat has been filed for Respondent No.2. It is clear that. Respondent No.2 having knowledge about filing of these petitions, did not choose to submit any objections over the present petitions. Heard Ms.K.Rithwika, learned counsel representing Sri N.Ashwani Kumar, learned counsel for the Petitioner. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor is in attendance. 3. 4 It is submitted by the learned counsel for the Petitioner that the subject matter of these Criminal Petitions is squarely covered by the similar order passed by this Court in Criminal Petition No.7671 of 2021 dated 10.01.2024. As seen from the copy of the Order passed in Criminal Petition No.7671 of 2021, in the similar circumstances and against the same Petitioner, this Court, by relying on various judgments of the Hon’ble Apex Court, has quashed the proceedings against the Petitioner in C.C.No.553 of 2020 on the file of the Court of Special Mobile Judicial Magistrate of First Class, Guntur. For ready reference the order passed in Criminal Petition No.7671 of 2021 is extracted hereunder: 4. 5. “In the instant case, the plea of the Petitioner/Accused No. 7 is that, he used to be a Director of A. 1-Company and subsequently on 29.02.2016 he resigned and since then he n/as not part of the affairs of the said Company. To substantiate the same, the relevant forms from ROC have been placed to indicate resignation. The said contention was not denied by Respondent No. 2, as none appeared, despite service. This would essentially indicate as an acceptable circumstance to conclude that the Petitioner herein resigned at the period in issue. Admittedly, the five cheques were issued in the year 2019, which were alleged to have been signed by Accused No.2, and the same were subsequent to the date of resignation of the Petitioner. Be that as may, no specific allegations are made against the Petitioner herein. The judgments of the Hon’ble Apex Court in Anita Malhotra, and Gunmala Sales Pvt Ltd., (referred supra) which were relied on by the learned counsel for the Petitioner are squarely applicable to the facts of the present case. In Mohammad Wajid V. State of U.P.^ the Hon'ble Supreme Court while reiterating position laid down in State of Haryana v. Bhajanlat' made a comprehensive analysis on the application of the Section 482. The Apex Court stressed on the necessity to arrive at a balance between the law enforcement power of the State and the protection of citizens from unjust criminal proceedings. It was observed that the right not to be disturbed without sufficient grounds is one of the mandates under Art 21 of the Constitution of India. Moreover, asjeferred in Harshendra Kumar ^2023(1)INSC 683 ^1992 Supp. (1)SCC 5 D, the initiation of criminal proceedings against an individual Is capable of yielding severe ramifications on a person and it would not be just to not consider the supporting documents placed by the Petitioner indicating his resignation. The Petitioner is no longer associated with A. 1-Company from the date of his resignation to the post of Director. Therefore, it can be said that the allegations mentioned in the complaint do not disclose any offence against the Petitioner herein. Viewed from any angle, continuation of proceedings against him, is an abuse of process of law. In view of the foregoing discussion, this Court finds that it is a fit case to exercise inherent Jurisdiction under Section 482 Cr.P.C to quash the proceedings against the Petitioner/Accused No.7 in C.C.No.553 of 2020. Accordingly, this criminal petition is allowed. The proceedings against the Petitioner/Accused No. 7 in C.C.No.553 of 2020 on the file of the Court of Special Mobile Judicial Magistrate of First Class, Guntur, registered for the offences punishable under Sections 138, 141, 142A and 143 of Negotiable Instruments Act, are hereby quashed.” 6. Inherent powers, as the word suggests, are inalienably present in the i'? ■ Court. They are not conferred, but are merely safeguarded and preserved by provision under Section 482 to the High Court. A bare perusal of Section 482 makes it clear that the Code envisages that inherent powers of the High Court are not limited or affected so as to triake orders as may be necessary; (i) to give effect to any order under the Code or, (ii) to prevent abuse of the process of any Court or, otherwise (iii) to secure ends ofjustice. A court while sitting in Section 482 jurisdiction must exercise its powers to do real and substantial justice, depending on the facts and circumstances of the case for compelling reasons of abuse of process of law or glaring injustice, which are against sound principles of criminal jurisprudence. In the instant cases, in the complaints, there is no reference that the 7. petitioner herein is responsible /or the day-to-day affairs of the A. 1-Company. 6 Further, the Petitioner is not the signatory of the subject cheques. Furthermore, as rightly put by the learned counsel for the Petitioner, and as seen from the material placed on record, the Petitioner was appointed as one of the Directors of A. 1-Company on 01.12.2006 and was continued till the date of his resignation on 29.02.2016. Whereas, the subjects are of the year 2019. Therefore, by the date of issuance of the subject cheques by Accused No.2 to Respondent No.2, the Petitioner/Accused Nb.7 was ceased to be the Director of A.1-Company. In view of the above discussion and the Order passed by this Court in Criminal Petition Nos.7671 of 2021, dated 10.01.2024 and taking into consideration of the facts and circumstances of the case, this Court is of the view that the Petitioner has not committed the offences under Sections 138, 141, 142-A and 143 of N.I.Act. Hence, continuation of proceedings in the above cases against the Petitioner is sheer abuse of process of law.
