The present petitions are being disposed of by a common order, as both the petitions have been filed,
2 against the common order, dated 23.9.2025, passed by the learned Civil Judge (Senior Division), Court No. 1 (Executing Order), Shimla, (hereinafter referred to as ‘the trial Court’), in Civil Execution No.203-10 of 2022, titled as, ‘Punjab National Bank versus Manoj Kumar & anr.’.
2. During the pendency of the present petitions, before this Court, the matter has been settled between the parties, under One Time Settlement scheme. In this regard, copy of letter dated 6.1.2026 has been placed on record, according to which, total outstanding amount is Rs. 3,45,104/-, out of which, a sum of Rs. 2,65,000/- is stated to have already been deposited, by the Guarantor Surinder Kumar Kalia, with the respondent-Bank and a sum of Rs. 80,104/- is yet to be deposited.
3. As per report of the Registry, a sum of Rs. 1,00,000/- has been deposited with the Registry of this Court, on 29.10.2025.
4. Since, the matter has been settled between the parties, as such, amount deposited by petitioner Surinder Kumar Kalia, is ordered to be released in favour of the respondent-Bank. The amount, so
3 released, shall be remitted to the bank account of respondent No. 1-Punjab National Bank, Sanjauli, particulars of which, shall be supplied by learned counsel for respondent No. 1 to the Registry of this Court.
5. In view of above, the present petitions are
disposed of. The pending application(s), if any, are also
