Without adverting in detail to the controversy in the present petition, the parties are ad idem that, in view of the Full Bench judgment of this Court in Komal Rugwani Vs. State of Maharashtra and Others, reported in 2011 (4) Mh.L.J. 301, an appeal before the School Tribunal would not lie at the behest of an employee who is working in the petitioner No. 2 School. In view of the same, the following order is passed: ORDER i) The judgment of the School Tribunal impugned in the petition, as also the enquiry conducted by the present petitioner, are also set aside. ii) However, the petitioners are granted liberty to take recourse to the Ashram Shala Sanhita with respect to the present respondent/employee for the alleged misconduct. iii) With these directions the petition is disposed of.
