Grievance of the petitioner is with regard to non-release of admitted dues. Pursuant to the order passed on the previous occasion, the amount found due and payable has been released to the petitioner. Contract otherwise was awarded in June, 2024. Learned counsel for the petitioner submits that the petitioner is also entitled to interest. Learned counsel for the respondents, however, submits that there is no clause providing for payment of interest in the agreement. He further submits that there is no unusual delay in release of amount and that the local body is otherwise facing financial crunch. Admittedly the contract has been awarded to the petitioner pursuant to the notice inviting tender issued by respondents. The admitted dues are already paid. If any sum towards interest is still due and payable as per the contract, the petitioner would be at liberty to pursue its remedy before the appropriate forum.
