[2025:RJ-JP:45554] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 12148/2025 Nathua S/o Shri Narayan Singh, R/o Pardeshiya, Mohalla Bari, Thana Bari District Dholpur. (The Accused Confined In District Jail Dholpur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Neeraj Sharma For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 13/11/2025 1. The petitioner has preferred this bail application under Sec- tion 483 of BNSS in FIR No.300/2025 registered at Police Station Bari, District-Dholpur for offences under Sections 109(1) and 333 of BNS. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the allegation against the accused-petitioner pertains to inflicting injury on the neck of the complainant but there is no medical opinion by which it can be inferred that the injury caused to the injured is dangerous to life. The charge-sheet has been filed and no custodial interrogation of the petitioner is required. The peti- tioner has been in judicial custody since 13.08.2025 without any [2025:RJ-JP:45554] (2 of 2) [CRLMB-12148/2025] criminal past. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the peti- tioner in further custody, hence, the bail application of the peti- tioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material avail- able on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/de- merits of the case, I am inclined to grant benefit of bail to the pe- titioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Nathua S/o Shri Narayan Singh shall be released on bail on his furnishing a per- sonal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
