Nos. 1 to 6 : Mr. Sanket Khanna, A.C. to A.A.G.-V Order No. 04 Dated: 08.04.2025 In course of argument, learned counsel for the petitioner confines the prayer made in the writ petition to the extent of directing the Deputy Commissioner, Godda (the respondent no. 2) to expedite the hearing of Revenue Misc. Appeal No. 45 of 2024- 25 filed by the petitioner challenging the order dated 23.08.2024 passed by the Sub-Divisional Officer, Mahagama, District- Godda (the respondent no. 3) in R.E.R. Case No. 17 of 2023-24 whereby he has been evicted from the land appertaining to Jamabandi No. 3, plot no. 369, Mouza- Chanda, Thana Nos. 181 & 184 measuring an area of 09 kathas 10 dhurs. 2. Learned counsel for the petitioner submits that on an application made by the respondent no. 7, the respondent no. 3, vide order dated 23.08.2024 passed in R.E.R. Case No. 17 of 2023-24, erroneously directed to evict the petitioner from 2025:JHHC:10792 2 the land in question. Aggrieved with the said order, the petitioner preferred appeal in the court of the respondent no. 2 on 07.12.2024 which was registered as Revenue Misc. Appeal No. 45 of 2024-25. During pendency of the said appeal, the petitioner was forcibly evicted from the said land. The grievance of the petitioner is that the said appeal is still pending before the respondent no. 2 and no effective step is being taken by the said respondent so as to dispose of the same expeditiously. Under the said compelling circumstance, the petitioner has preferred the present writ petition. 3. Mr. Sanket Khanna, learned A.C. to A.A.G.-V, appearing on behalf of the respondent nos. 1 to 6, submits that the respondent no. 2 shall make due endeavour to dispose of the aforesaid appeal expeditiously. 4. Having heard learned counsel for the parties and considering the submission of learned counsel for the petitioner that the petitioner has been evicted from the land in question during pendency of Revenue Misc. Appeal No. 45 of 2024-25, the respondent no. 2 is directed to expedite the hearing of the said appeal and to dispose of the same in accordance with law preferably within two months from the date of receipt/production of a copy of this order. 5.
