Ms. Manisha Rana Singh, D.A.G. for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in FIR/Case Crime No. 278 of 2023, under Sections 20/8/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Pulbhatta, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 17.12.2023, while intercepting a vehicle, a person sitting on a bus tried to throw a bag out from the bus, but he was intercepted. There was 1.545 Kg. charas in it. He was the co-accused Virendra Kumar. FIR records that the co-accused has brought the substance from one carwala. According to the prosecution, the carwala is the applicant. 4. Learned counsel for the applicant would submit that the co-accused from whose possession, charas was 2 recovered has already been granted bail. There is no material against the applicant, except the statement of the co-accused. 5. Learned State counsel would submit that the only evidence against the applicant is the statement of the co-accused and also the call details record of another co- accused who was to receive the charas from the applicant. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
