PUBLIC PROSECUTOR 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 10818/2025 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS, has been filed by the Petitioner, seeking to relax/modify the condition of imposing Rs.8,00,000/- towards surety amount for release of the vehicle passed by the learned I Additional District and Sessions Judge-cum- Special Judge for Trial of Offences under NDPS Act, Vizianagaram, in Crl.M.P.No.517 of 2025 dated 24.06.2025 in Crime No.36 of 2024 of S.Kota Police Station. 2. Heard Sri Kakumanu Joji Amrutha Raju, learned counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. The learned counsel for the petitioner submits that the petitioner is aggrieved by the order, dated 24.06.2025, in Crl.M.P.No. 517 of 2025, passed by the I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Vizianagaram, whereby the learned Sessions Judge directed the release of the vehicle Swift Dzire Car bearing registration No.AP 39 UD 6664, subject to the petitioner executing a personal bond of Rs.8,00,000/- with two sureties for a like sum, to the satisfaction of I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Vizianagaram. 3 4. The learned counsel for the petitioner submits that the condition imposed by the learned Sessions Judge with respect to surety amount is onerous. 5. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 6. Considering the submissions, the order stands modified to the extent that the petitioner executing a personal bond for the value of the subject vehicle to be assessed by the Motor Vehicle Inspector, with two sureties for the like sum each, to the satisfaction of I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Vizianagaram. The rest of the conditions imposed by the learned Sessions Judge shall remain unaltered. 7. With this modification, this Criminal Petition is disposed of.
