The petitioner is challenging the inaction on the part of the respondents in considering the representations dated 25.02.2012 and 27.02.2012. -2- W.P. No.6352 of 2012^ 2. The respondents proposed to fill up the post of Anganwadi worker in the additional Anganwadi Centre situated in Kimmuru Village of Rampachodavaram Mandal, East Godavari District, and issued a notification reserving the post for a Scheduled Tribe category. The petitioner belongs to the Scheduled Caste community and has also applied for the said post. There was no Scheduled Tribe candidate in the Village and as such, requested the respondents to consider her candidature in the absence of the Scheduled Tribe candidate. Representation of the petitioner was pending consideration by the respondents. 3. This Court, vide order dated 12.03.2012, directed the respondents not to fill up the post unless the Scheduled Tribe candidate is available until further orders. 4. This writ petition has been pending for the last 13 years, and the respondents have not filled the post in view of the interim direction granted by this Court. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader representing the respondents submits that the respondents are willing to issue a fresh notification for filling up the post of Anganwadi worker subject to further directions of this Court. -3- W.P. No.6352 of 2012 5. Considering the aspect that the post of Anganwadi worker in the Anganwadi centre has been vacant for all these years, this Court is inclined to dispose off the writ petition, leaving it open to the respondents to take steps for filling up the post of Anganwadi worker by issuing fresh notification. The respondents shall issue fresh notification duly considering the availability of the category reserved for the said post. Furthermore, the notification should include necessary instructions in the event a candidate from the reserved category is not available. 6. Accordingly, the writ petition is disposed off.
