JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 22-09-2025 Being aggrieved by the encroachment proceeding being Encroachment Case No. 04 of 2024-25 initiated by the Circle Officer, Naubatpur, with respect to land pertaining to Thana No. 117, Khata No. 276 and Khesra No. 1896, declaring it to be ‘Gairmajarua’ land, by which the petitioners have been summoned to submit their supporting document with respect to their title and possession over the said land on 15.02.2025, the petitioners have approached this Court by way of the present writ petition. 2. It is, prima facie, apparent from the record that the petitioners have approached this Court in haste. They ought to have filed their objection before the concerned Patna High Court CWJC No.8610 of 2025(2) dt.22-09-2025 2/2 Circle Officer in light of notice dated 01.02.2025 (Annexure- P/4) with all supporting documents with respect to their title and possession over the land in question. However, the petitioners have chosen not to appear before the Circle Officer, Naubatpur and filed this writ petition before this Court, which, in my view, is a pre-mature application, therefore, the same does not warrant any interference of this Court at this stage. 3. Accordingly, this writ application is disposed with direction to the petitioners to file objections before the Circle Officer, Naubatpur with all supporting documents relating to their title and possession over the land in question. If such objection is filed within one month, the Circle Officer shall decide the same after giving opportunity of hearing to the petitioners and all concerned within a reasonable time frame. brajesh/- (Anil Kumar Sinha, J) U
