PUBL-lC PROSECUTOR +: I The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking regular bail, in Crime No,173 of 2024 of Pachipenta Police Station, ParvathiPuram diStriCt- 2, A case has been registered against the Petitioner herein for the offence puni`shable under section 20(b)(ii)(B) read With <\ 2 Jfy 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 02.12.2024, at about 08.00 hours, on receipt of credible information, the Sub- Inspector of Police, Pachipenta Police Station, along with his staff and mediators, while conducting vehicle checking at P. Konavalasa Police Check-post, near Goddess Durga temple of P. Konavalasa village, Pachipenta mandal, found the accused in possession of 5.180 KGs of Ganja. The contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. Petitioner was arrested on 02.12.2024 and since then he is in judicial remand. The quantity of Ganja allegedly seized from the possession of the accused is 5.180 Kgs, which is not a commercial quantity. Learned Assistant Public Prosecutor submitted that there are no antecedents against the petitioner herein and major portion of investigation has been completed. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/Accused on the following conditions. 3 I/ i) The petitioner/Accused shall be released On bail on his executing a personal bond for Rs.10,000/- (Rupees Ten i..J'._ I Thousand only) with two Sur?I.ieS Of the like sum each tO the _,i-,-~ _.. satisfaction of the learned Judicial Magistrate of First Class, Salur. ii) on release, the petitioner shall appear before the station House Officer concerned, Once in a Week i.e., On every saturday between 10.00 am and 01.00 pm, till filing Of the charge sheet. i'Ii) Petitioner herein/Accused shall not gO beyond the jurisdiction of parvathipuram distr'lct, Andhra Pradesh State, without leave of the trial Court and he Shall make available his location through mobile phone by pairing it with the mobile phone of the Investigating OffICer round the CIock. 7.
