Petitioner Naveen Sharma has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 124 dated 20.03.2025 under Section 351(3), 75(2), 78 of Bharatiya Nyaya Sanhita, 2023 registered at Police Station City Hisar (Annenxure P-1).

As per the facts of case, prosecutrix gave her statement that she is student of 3rd year in Guru Jambheshwar Science and Technology University, Hisar. Naveen Sharma student of B.Tech Mechanical 3rd year was harassing her for last one year. He threatened her and applied colour on her on the day of Holi festival and touched her in an inappropriate manner. He stalked her and hurled abuses. On 19.03.2025, he tried to kill her by hitting his motorcycle. With these allegations, present FIR has been LALIT SHARMA 2025.05.02 16:06 I attest to the accuracy and integrity of this document

Learned counsel for petitioner argued that prosecutrix and accused/petitioner are students of same institution. Allegations against him are vague nor there is any proof of said allegations. It is pointed out that father of petitioner had paid Rs. 10,000/- to the father of complainant and when money was demanded back, petitioner was falsely implicated in this case. His anticipatory bail application was wrongly declined by learned Additional Sessions Judge-cum-Judge, Special Court for Heinous Crime Against Women at Hisar vide order dated 28.03.2025. Petitioner is ready to abide by terms of bail order. It is prayed that his anticipatory bail petition may be allowed.

Bail petition is opposed by learned counsel representing State. Status report has been filed. It has come on record that prosecutrix is student of 3rd year B.Sc Mathematics, whereas petitioner/accused is 3rd year student of B.Tech Mechanical in same University. There are allegations of continuous stalking and misbehaving with prosecutrix. She has also narrated two incidents when petitioner touched her in an indecent manner and on one occasion he tried to strike his motorcycle against her. Apart from the statement of prosecutrix, statements of other students were also recorded. Investigating Agency has further collected record of proceedings of Proctorial Board (Annexure R-1) consisting of several members and in those proceedings, present petitioner has been rusticated from University with immediate effect for two years.

I have considered the aforesaid factual position. Considering the specific allegations and inappropriate behaviour of petitioner in educational institute towards other students i.e. the victim studying in University, he is required to join investigation. Action taken by University is also clear from the proceedings of Proctorial Board (Annexure R-1). In the light of aforesaid factual position, I do not find it an appropriate case for grant of anticipatory bail to petitioner and petition filed by him is accordingly, dismissed.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
