This criminal miscellaneous bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.194/2025 registered at Police Station Kanwas, District Kota Rural for the offences punishable under Sections 115(2), 126(2) and 189(2) of the B.N.S., 2023. 2. Learned counsel for the petitioner submits that the petitioner is a lady aging 60 years and although one of the injuries sustained by the injured is grievous and has been opined to be dangerous to life, yet such injury has not been assigned to the petitioner. The petitioner is behind the Bars since 26.11.2025, no recovery is to be effected against the petitioner and the investigation qua her has already been completed. The trial of the case is likely to take considerably long time, hence, learned counsel for the petitioner, prays for granting bail to the petitioner. [2025:RJ-JP:51142] (2 of 2) [CRLMB-16261/2025] 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Considered the submissions made at Bar. 5. In view of the fact that the injury which is grievous in nature has not been assigned to the petitioner and petitioner is a lady of 60 years of age and that she is behind the Bars since 26.11.2025 as well as looking to the fact that the trial will take considerably long time, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, this Bail Application is hereby allowed. The accused-petitioners Smt. Prembai W/o Ramnarayan, shall be released on bail in pursuance of FIR No.194/2025 registered at Police Station Kanwas, District Kota Rural on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:- (i) She shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) She shall not leave the country without prior permission of the Court. (iii) She shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court. (ANAND SHARMA),J SOURAV /260
