This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:

“to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the action of the respondents herein, in trying to sourcing/appointing Shift Operators for manning 33/11 KV Sub-stations and for undertaking other works, in Tekkali Division, without following the guidelines issued by the Chairman & Managing Director, Eastern Power Distribution Company of A.P. Ltd, Corporate office, Visakhapatnam, the 2nd respondent herein, vide memo No.HRD/MPS/MPP/ F.No.811/ 11D.No.450/11 dt.8.7.2011, as illegal, arbitrary, without jurisdiction, discriminatory, in violation of Article 14 and 16 of the Constitution of India and contrary to the guidelines issued by the corporation from time to time more particularly Memo No.HRD/MPS/MPP/F.No.811/11D.No.450/11 dt.8.7.2011 and further direct the respondents herein, to sourcing/appoint qualified personnel for manning the substations and for undertaking for other works in Tekkali Division, strictly in accordance with the guidelines issued by the Chairman & Managing Director, Eastern Power Distribution Company of A.P.Ltd., Corporate office, Visakhapatnam, the 2nd respondent o herein vide Memo.No.HRD/MPS/MPP/F.No.811/11D.No.450/11 dt.8.7.2011...”

The sum and substance of the writ petition is that the petitioners are challenging the action of the respondents in attempting to appoint shift operators for manning the 33/11 KV Sub- Stations and undertaking other works in the Tekkali Division without adhering to the proceedings of Respondent No.2, as per the memo dated 08.07.2011. 3
3. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioners. 4. Learned Standing Counsel for Respondents 2 to 5/APEPDCL, on written instructions, would submit that the orders issued vide Memo No. HRD/MPS/MPP/F.No.811/11/D.No.450/11, dated 08.07.2011, has been kept in abeyance until further orders, as per Memo No. HRD/MPS/MPP/F.No.811/11/D.No.729/11, dated
17.10.2011.
Presently, they are not contemplating to revoke the said abeyance orders. 5. A plain reading of the written instructions submitted by the learned Standing Counsel for Respondents 2 to 5/APEPDCL indicates that the petitioners are seeking implementation of the orders dated 08.07.2011, which were kept in abeyance until further orders vide order dated 17.10.2011. Now, as per Memo No. CGM/O&CS/EPDCL/VSP/GM-II/O&M-II/O&M-II/DE/O&M/D.No.35 32, dated 11.09.2014, instructions are being followed while engaging contract labour/outsourcing employees through an agency, duly following ROR. 6. Recording the submissions made by the learned standing counsel for the respondents 2 to 5/APEPDCL and the contents of

the written instructions submitted by the learned Standing Counsel for respondents 2 to 5, the Writ Petition is disposed of. However, the petitioners are at liberty to work out their remedies by challenging proper cause of action in accordance with law. No costs.
