Applicant has filed this application under Section 447 B.N.S.S. seeking transfer of Case No. 383 of 2014, titled Anju Sharma and another Vs. Ramesh Sharma, under Section 125 Cr.P.C., pending before the Principal Judge, Family Court, Court No.7, Kanpur Nagar to the court of competent jurisdiction at Jhansi. Learned counsel for the applicant has argued that as a result of a matrimonial dispute between the opposite party no.2 and applicant, litigation between the parties commenced, and three cases at the instance of opposite party no.2 are pending at Kanpur Nagar. The cases are for maintenance under Section 125 Cr.P.C.; prosecution of applicant under Section 498-A IPC etc. and a complaint under Protection of Women from Domestic Violence Act, 2005. He submits that the applicant is permanent resident of Ujjain and it is difficult for him to travel to Kanpur Nagar on each and every date of hearing. Further, it is pointed out that on 18.12.2023, the accused were attacked by the opposite party no.2 and her associates and a complaint in this regard was given on 11.01.2024. He prays that the trial be transferred to Jhansi. Upon hearing the learned counsel for the applicant and considering his submissions, this Court finds that no sufficient ground is made out by the applicant for transfer of the case from District Court Kanpur Nagar to Jhansi, as convenience of one of the parties alone cannot be treated as a valid ground for transfer of the case. In view of the above, the application is dismissed.
