Neutral Citation No. - 2025:AHC:58436 Court No. - 4 Case :- WRIT - A No. - 5060 of 2025 Petitioner :- Pooran Chandra Sharma Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Jitendra Nath Singh,Sarvesh Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Jitendra Nath Singh, learned counsel for the petitioner as well as learned Additional Chief Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned both the orders by which the recovery by way of punishment has been passed as well as the
order of appellate authority. Learned Additional Chief Standing Counsel submits that the petitioner has an alternative efficacious remedy of revision under the U.P. Government Servants (Discipline and Appeal) Rules, 1999 and accordingly petitioner may be relegated to the remedy of revision.
Learned counsel for the petitioner could not dispute the above legal provision. In view of the above, I decline to entertain the petition at this stage, however, leaving it open for the petitioner to apply for revision before the competent authority. It is further provided that in the event petitioner prefers a revision over and above the order of appellate authority as well as the disciplinary authority before the competent authority within a period of four weeks from today along with the certified copy of this order, the said revision shall be considered and disposed of within a further period of two months by means of a reasoned and speaking order. However, for a period three months or until the disposal of revision petition, whichever is earlier, no recovery shall be proceeded against the petitioner pursuant to the orders impugned. With the aforesaid observations and directions, this petition stands
disposed of.
