HON'BLE MR. JUSTICE RAJESH BHARDWAJ Present: Mr. Kamaldeep Singh Sodhi, Advocate, for the petitioner. Rajesh Bhardwaj, J. (ORAL) Prayer in the present petition is for issuance of directions to respondents No.2 and 3 to take action against respondents No.4 to 7 for misusing the cheques of the petitioner. It has been contended by learned counsel for the petitioner that the petitioner entered into an agreement to sell with respondents No.4 to 7. He submits that the petitioner had advanced earnest money of Rs.10 lacs, but respondents No.4 to 7 did not come forward for execution of the sale deed. He submits that thereafter, respondents No.4 to 7 filed a suit for specific performance, which is pending adjudication. He submits that cheque book of the petitioner was stolen by respondents No.4 to 7 and there is every probability that complaint under Section 138 of the Negotiable Instruments Act, 1881 would be filed against the petitioner by them. He, thus, submits that action be taken against the private respondents. Notice of motion. Mr. Tarun Aggarwal, Sr. DAG, Punjab, accepts notice on behalf of the State. After hearing learned counsel for the the parties, the present petition is
disposed of with liberty to the petitioner to file a consolidated representation/complaint for the redressal of his grievance before respondent No.2 i.e. the Commissioner of Police, District Amritsar within a period of ten days from today. If any such representation/complaint is filed, the same be dealt with expeditiously in accordance with law.
