2. The petitioner, Senior Assistant, Office of Tahsildar, Musunuru Mandal, Eluru District, filed the above writ petition to declare the action of the
2 respondents in not considering the petitioner’s case for promotion to the post of Deputy Tahsildar due to the pendency of departmental proceedings, as illegal and arbitrary. A charge memo vide CCLA’s Proceedings No.REV02-28/25/2021- VIGILANCE II SEC-CCLA, (C No.1561697) dated 09.08.2023 (Ex.P.9) was issued to the petitioner. The petitioner made a representation dated 16.10.2023 and requested the authority to submit certain documents enabling him to submit a written defence.

Learned counsel for the petitioner would submit that though the petitioner is entitled to promotion to the post of Deputy Tahsildar, his case is not considered for promotion due to the pendency of the aforementioned charge memo. At the hearing,
learned counsel for the petitioner has confined his argument and urges to direct the 4'*^ respondent to consider the petitioner’s case for promotion in terms of G.O.Ms.No.257 dated
10.06.1999. Learned Assistant Government Pleader for Services did not refute the said submission.

6. The Government issued G.O.Ms.No.257, dated 10.06.1999 to meet the contingency referred to supra. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the admission stage, with the consent of learned counsel on either side, directing 4**^ respondent to consider the petitioner’s case for promotion to the post of Deputy Tahsildar, strictly in terms of G.O.Ms.No.257, dated 10.06.1999, if the petitioner’s
