The petitioner has preferred the present petition with the following prayer:- I-Issue a writ, order or direction in the nature of mandamus commanding the respondents to direct the respondents to recover the amount and make the payment to the petitioner with 18% interest within a stipulated period. 2. Facts in brief as contained in the writ petition are that the petitioner raised an Industrial Dispute being Misc Case No.196 of 1999 under Section 33-C (2) of the Industrial Disputes Act, 1947 before the Labour Court Saharanpur. The aforesaid claim/case was allowed by the Labour Court, Saharanpur vide its order dated 20.08.2003. The operative portion of the aforesaid order reads as follows:- अततः पप्रारर्थीगण कप्रा 2-ए पप्राररनप्रा पत्र अन्तगरत धप्रारप्रा 33-ससी 2 औदद्योगगक गविविप्राद अधधगनयम 1947 अंकन 3,37,944-16 पप्राप्त हहेततु स्विसीकप्रार गकयप्रा जप्रातप्रा हह , तरप्रा पप्रारर्थीगण इस धनरप्रागशि पर पप्राररनप्रा पत्र ककी गदनप्राअंक सहे भतुगतप्रान ककी गतधर तक 8 पगतशिप्रात सप्रालप्रानप्रा बयप्राज पप्राप्त करनहे कहे अधधधकप्रारसी हह, तरप्रा इस पर विप्राद कप्रा खरप्रार 1000/= पप्राप्त करनहे कहे अधधकप्रारसी हह । अगर यह धनरप्रागशि आदहेशिप्रा ककी गदनप्राअंक सहे 3 मप्राह कहे अन्दर नहहीं भतुगतप्रान ककी गई , तद्यो गविपकसीगण सहे 10 पगतत्विप्रात सप्रालप्रानप्रा ब्यप्राज पप्राप्त करनहे कहे अधधकप्रारसी हद्योगग । 3. Against the aforesaid order, Writ C No.73143 of 2005 had been filed by the respondent No.3/Secretary, The Saharanpur Whole Sale Consumer Cooperative Store Ltd. Saharanpur before this Court in which recovery proceedings initiated against him was stayed by this Court vide its order dated 21.04.2006. Ultimately, the writ petition was dismissed by this Court vide order dated 17.01.2023. After dismissal of the aforesaid writ petition, recovery certificate was issued by the Deputy Labour Commissioner, Saharanpur Region, Saharanpur/respondent No.4 by which a request has been made to the District Magistrate, Saharanpur to recover a sum of Rs.3,41,478/- from the respondent No.3. 4. It is argued by learned counsel for the petitioner that considerable time has been lapsed but till date nothing has been done in the matter. 5. On the other hand, it is argued by learned Standing Counsel that the respondent No.2/District Magistrate, Saharanpur will take a decision in the matter expeditiously. 6. Heard learned counsel for the parties and pureed the record. 7. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/District Magistrate, Saharanpur to take a decision in the matter pursuant to the letter/recovery certificate dated 19.06.2023 most expeditiously and preferably within a period of two months from the date of production of certified copy of this order unless there is no legal impediment.
