ORDER Date : 19-03-2025 Heard Mr. L. Perme, learned counsel for the petitioner. Also heard Mr. N. Ratan, learned Additional Advocate General for respondents No.1 to 5.
This is an application filed under Article 226 of the Constitution of India challenging the recommendation made by the Tender Committee dated 04.03.2025, whereby contract work was recommended to L-2 and not to the petitioner being L-1.
The Director, Biological Park, Ganga, Itanagar invited tender vide NIT No.DBP-18/2025/1473-77 on 14.02.2025. The present petitioner filed his tender and he procured L-1 position but in spite of that, the other
Page No.# 3/3 tenderer L-2 was recommended by the Tender Committee.
Mr. L. Perme, learned counsel submits that petitioner has filed his representation on 10.03.2025 before the Director, Biological Park, Itanagar-cum-the Chairman, Tender Board of the NIT No. DBP- 18/2025/1473-77 dated 14.02.2025. Mr. L. Perme, learned counsel submits that the said representation is yet to be disposed of and therefore, he prays for a direction to the respondent No.5 to dispose of the representation of the petitioner within a fixed time limit.
Mr. N. Ratan, learned Additional Advocate General submits that he has no objection if the Court passes such an order for disposal of the representation of the petitioner.
Accordingly, the Director, Biological Park, Itanagar-cum-the Chairman, Tender Board of the NIT No. DBP-18/2025/1473-77 dated 14.02.2025, is directed to dispose of the representation of the petitioner dated 10.03.2025 within 1(one) week from receipt of certified copy of this
order.
The writ petitioner stands disposed of, accordingly.
