Heard Mr. Devesh G. Kela, learned counsel for the petitioners. Also heard Mr. Swajeet Ubeja, learned Panel Lawyer for the respondent No.1 / State. 2. The petitioner has filed this petition praying for following relief:- “1. Quash the F.I.R./Crime No 0243/2025 registered against the Petitioners on complaint made by the Respondent No.2 in Police Station- Mahasamund, District- Mahasamund (C.G.) and the subsequent proceedings (if any) in consequence to the complaint of the Respondent No.2. 2. Stay the further proceedings F.I.R. /Crime No 0243/2025 registered in Police Station- Mahasamund, District- Mahasamund (C.G.). 3. To grant such other reliefs as it deems fit in the circumstances of the case the interest of justice and to fulfill the purpose and purport of 528 of the Bhartiya Nagarik Suraksha Sanhita.” 3. From perusal of the relief prayed for in the present petition, it transpires that the same is a defective one as the counsel for the petitioner has not mentioned the particulars with respect to the FIR as to under what the charges the FIR has been registered and he has only drafted a vague and sketchy prayer. 4. In view of the same, learned counsel for the petitioner prays to withdraw the present petition, with liberty to file afresh with 3 appropriate prayer and pleadings. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate prayer and pleadings, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government School for Visually Handicapped Boys and Girls , District- Jaspur (C.G.), for wasting the precious time of this Court. 6. Learned Panel Lawyer appearing for respondent No.1 / State is present. 7. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
