ORDER:
1. The petitioner is arraigned as Accused No.3 in Crime No. 128 of 2024 on the file of the Gudur I Town Police Station, Tirupati District, for the alleged offences under Sections 20(b)(ii)(c) read with Section 8(c) of the Narcotic Drugs and Psychotropic Substances Act.
2. The learned counsel for the petitioner submits that the petitioner is falsely implicated in this case and that he was implicated basing on the confession of Accused No.1. It is submitted that the petitioner could not have been arraigned as accused on the confessional statement of the co-accused. It is also submitted that no material was seized from the accused and as such the case registered against the petitioner ought to be quashed.
3. The learned Assistant Public Prosecutor submits that the investigation is in preliminary stage and that involvement of the petitioner or otherwise would be ascertained by the police after completing the investigation. It is also submitted that in cases of this nature there may not be direct evidence available to link the accused with the crime. However, during the course of investigation, the police would have to establish the nexus by conducting a thorough investigation, interference by this court in the crime stage would hamper the investigation of the police. 4. Heard the submissions of the
learned counsel appearing for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
5. Considering the submissions, this court is not inclined to interfere at the stage of investigation. Police would have to be given a free hand for completing investigation. Without opining on the merits of the case, it is left open for the police to complete investigation in accordance with law.
6. Accordingly, criminal petition is dismissed.
7. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
